1These Terms of Purchase
1.1 These terms of purchase ("Terms of Purchase") apply when you as an individual make a purchase from www.hookseurope.com and thereto related websites (the "Website"). When you make a purchase on the Website, an agreement is entered into between you as an individual and Hööks Hästsport AB, with organization number SE5561582213101, Företagsgatan 58, 501 77 Borås ("Hööks", "us" or "we").

3Agreement and order
3.1 When you make a purchase on the Website, you will accept these Terms of Purchase, which apply to all our sales to private individuals (consumers). You need to be over 16 years of age and have the right to enter into an agreement in accordance with applicable law, e.g. not be under guardianship. Our minimum order value is € 50. This means that we do not accept orders under € 50.
3.2 When you have completed your purchase, a preliminary order confirmation is shown on the Website. The preliminary order confirmation is shown automatically and is only a confirmation that we have received your order but is not a confirmation that a binding agreement has been entered into. A binding agreement is only entered into when we confirm your purchase and send a final order confirmation to the email address you provided in connection to the purchase. When your order is sent you will receive an email with a tracing link to the package.
3.3 We may decline your order if you have provided us with incorrect information at checkout, if we suspect an attempt to commit fraud or if the order cannot be completed since the product you have ordered is out of stock. In such cases, we will notify you as soon as possible.
4Price and payment
4.1 When ordering, the prices that are stated on the Website at the time of ordering will apply. All prices are represented in the local currency including applicable VAT.
4.2 If the price or information about a product listed on the Website is incorrect and you realized or should have realized that, the price or information will not apply to the purchase. In such cases, we will contact you as soon as possible.
4.3 We offer different payment options. The available payment options and any limitations are stated on the Website and at checkout. We and our payment service provider have the right to choose which payment options we from time to time offer.
4.4 We offer Klarna Checkout as our payment provider. Through Klarna Checkout, you can choose the payment method. In connection to your payment, you enter in to an agreement with Klarna and the right to receive payments from you and thereby connected rights therefor belongs to Klarna. Payment may therefore only be made to Klarna and Klarna´s terms and conditions will apply in addition to these Terms of Purchase, see Klarna´s conditions here. If you choose to pay using credit Klarna is the creditor.
5Shipping and delivery
5.1 Products are delivered to you with the delivery option you choose at the checkout. You will find information about your options on the Website and at the checkout. Depending on which shipping method you choose and the total amount of your order, shipping fees may apply. The delivery fee is free if you order for more than € 100. If you order for less than € 100, your shipping cost will be € 7,90. Any shipping costs will only be added once per order, regardless of the number of packages in the order.
5.2 The expected delivery time is stated on the Website and in the order confirmation and may differ depending on which delivery option you choose. We always strive to deliver your order within the estimated number of working days for delivery, stated on the Website and in your order confirmation. Please note that the time for delivery may vary depending on where you live, what delivery option you choose and the season. If your order is delayed, we will notify you and you have the right to cancel your order if the delay has a significant impact on you.
5.3 In connection to your delivery you will get a notification via SMS, phone or email. If your order is sent via a courier and you have neither supplied a mobile number nor an email address you will be sent a delivery notice via mail. You are responsible for picking up your order within the time stated on the delivery notice.
5.4 Dependent on what country version of our website you make your purchase from we will deliver either to Sweden, Norway, Denmark, Finland, the Netherlands or the rest of the European Union (EU). In order to receive your order to an EU address outside of Sweden, Norway, Denmark, Finland or the Netherlands, you must place your order on the EU website. If there are any limitations regarding delivery, we will inform you at the beginning of the ordering process.
6Partial delivery
  If your order contains several items and some of the items are temporarily out of stock, we will divide your order into several deliveries. The out of stock item will be delivered to you at a later date free of charge. You always have the right to cancel the delayed item.
7Uncollected packages
  Packages that are not picked up within the time specified on the delivery notice will be sent back to our warehouse. If you do not inform us that you wish to withdraw from your purchase, we have the right to charge an administrative cost of € 19 which corresponds to our costs for handling and shipping in cases where you do not collect your package.
8Offers, discount codes and gifts
8.1 We may from time to time offer promotions, discount codes, gifts and other offers ("Offers"). Such Offers are only valid for the time period specified in connection with the Offer and as long as the product is in stock. Offers cannot be combined with other discounts unless expressly stated on the Website. In addition to any specific terms, These Terms of Purchase will apply to Offers.
8.2 Upon termination or revocation of an Offer, these Terms of Purchase apply to the products that previously were subject to an Offer.
9Right of withdrawal and returns
9.1 According to EU consumer protection legislation, you have the right to cancel your purchase within 14 days from the day you, or a person on your behalf, receive the product that you have purchased on the Website.
9.2 In addition to this, we give you a right to return for another 46 days (a total of 60 days). However, we do not offer the extended right to return items purchased on sale or for goods that are not completely unused, which you can read more about below.
9.3 When you exercise your legal right of withdrawal of 14 days, you have the right to open the packaging and examine the product to the extent required in order to assess its character, quality and function. In these cases, you have the right to a full refund if you notify us within 14 days from the day you received the product. If you handle the product to a greater extent than required to determine its character, quality and function, we have the right to deduct a sum from the refund. You may read more about what this means below.
9.4 If you wish to exercise your extended right to return after the statutory 14-day right of withdrawal has expired, you may do so for up to 60 days after delivery of the product, provided that the product is unused, in its original condition and in its original packaging. This means, for example, that a horse rug needs to be clean and dry as well as free from hair and fur in order to be covered under the right to return.
9.5 If you wish to exchange a product you may do so by returning the product and placing a new order on the Website.
9.6 For certain products, neither the right of withdrawal nor the extended right to return applies. If a product is not suitable for return due to health or hygiene reasons, you will not be able to return the product if you have broken the seal on the product. Also, you do not have the right to return a product that has been manufactured according to your instructions or that otherwise has been given a clear personal touch. For example, items that are ordered with embroidery. If the right of withdrawal or the extended right to return does not apply, it will be stated in connection with the product.
 How to return
9.7

You can use your right of withdrawal by sending the product back to us. For easy handling, we recommend that you use the pre-printed return label or our standard form for right of withdrawal, in order to send the package back to us. You may also contact us at info@hookseurope.com

9.8 If you choose to send back your order, you will pay for the return shipping fee. The shipping fee varies depending on what delivery service you use.
 Your refund
9.9 If you use your right of withdrawal within 14 days, we have the right to deduct the amount by which the value of the product has been reduced if you have used the product more than necessary to determine its character, quality and function. Such a deduction is made according to the product's value upon return compared to the original value at the time of purchase. If you want to return a purchase made at the original price after the 14-days legal right of withdrawal has passed, you are entitled to a refund for up to 60 days only if the product is unused, in its original condition and in its original packaging.
9.10 You will receive your refund within 14 days from the day you notified us that you want to withdraw from your purchase or announced that you wish to use your extended right to return. However, we will not make the refund until we have received the returned product or before you have shown that you have sent it to us. Refunds will be made to you using the same payment method you chose at the time of purchase, unless there is a hindrance for such refund or if it is otherwise agreed. When you enter into a separate agreement regarding payment with our payment provider the payment provider will handle your refund.
10Complaints
10.1 If there is something wrong with your product, you have the right to complain about the faulty product in accordance with mandatory consumer protection legislation that applies in the country where you have your domicile.
10.2 To make your complaint, we recommend that you use the claims report at the back of the delivery note. You can also always contact us on info@hookseurope.com or +46 33 20 51 40. Our return address is Hööks Hästsport AB, Företagsgatan 58, 501 77 Borås. If you want to complain about a product, please contact us as soon as possible after you have discovered the error.
10.3 When the complained product has been received and it has been established that the complaint is valid, we will reimburse you in accordance with applicable law. This means that the defected product will be rectified or that we will replace the product with a new one. If none of these options are possible, you have the right to demand a price reduction corresponding to the error or cancel the purchase in accordance with applicable law. You are also entitled to compensation for your damage in accordance with applicable law. Please note that we have the right to decline a complaint if it turns out that the product is not defective according to applicable law.
11Our obligations
11.1 If there is any defect in your product or if the delivery is delayed, we are responsible for the damage you suffered as a result of the defect or delay in accordance with applicable mandatory consumer protection legislation. However, we are only liable for damages to the extent that you have taken reasonable steps to limit your damage. We are therefore not responsible for damages that you could have avoided by taking reasonable steps.
11.2 We are not liable for damages caused by unforeseen circumstances beyond our control, for example wars or natural disasters, which we could not reasonably have foreseen (Force Majeure). However, you always have the right to cancel the purchase in accordance with mandatory consumer protection legislation.
12Miscellaneous
  We reserve the right to transfer all or some of our rights in accordance with this agreement to third parties without your previous consent. We furthermore acknowledge the right to transfer or pledge our right of payment to third parties without your previous consent. You may on the other hand not transfer any part of your right or obligations in accordance with this agreement without our previous written consent.
13About these Terms of purchase
13.1 We have the right to change these Terms of purchase, but the Terms of purchase that you approved at the time of your purchase will always apply to that purchase. The latest published version of the Terms of Purchase is always available on the Website. Changes will come in to effect from the time you have accepted the Terms of Purchase, i.e. in connection with you making a new purchase on the Website.
13.2 We are a Swedish company with our head office in Sweden and are therefore covered by both Swedish and European law. However, you always have the right to exercise the rights that exists for consumers in the country where you are domicile. This means that we will always comply with mandatory consumer protection legislation that are in force in your country. We have no intention of excluding or restricting such right through these Terms of Purchase.

14.4 Notwithstanding the above, any disputes may also be settled in any competent court where the customer is domiciled.
